This Agreement is a contract between the customer (“You”) and WHAT HE WANTS GROOMING FOR MENS STORE (Company Reg No. 53082120J), a company incorporated in Singapore and having its registered address at 12, Woodlands Square #15-75 Singapore 737715 (“the Company”). Please review the following terms and conditions of use, which govern your use of the site.  By completing the customer registration process and/or placing an order at WHAT HE WANTS GROOMING FOR MENS STORE, you acknowledge that you have read and understood the terms and conditions of this Agreement and agree to be bound by the same. The Company reserves the right to modify the terms and conditions herein without notice. Your continued use of the WHAT HE WANTS GROOMING FOR MENS STORE or the services of the Company after any such changes constitutes your agreement to such changes.

1. ELIGIBILITY

1.1 To be able to make purchases through our Sites, you will be required to provide us with your personal details. In particular, you will be required to provide us with your name, postal address, e-mail address and/or other contact details as indicated.

1.3 Please note that if you do not provide us with all the information we need, you cannot place or process your order.

You may not use the Sites (and any goods or services purchased on or via the Sites), or any of its content, to further any commercial purpose, including, without limitation, any commercial activity on your own website, auction sites, group buying sites, social media sites or otherwise.

access or use the Sites or any Interactive Services for any illegal purpose or in violation of any applicable laws. You agree that you shall access and use the Sites or any Interactive Services in good faith;

attempt to gain unauthorised access to or otherwise interfere or disrupt other computer systems or networks connected to the Sites or the Interactive Services; or

interfere with another user’s utilisation and enjoyment of the Sites or the Interactive Services.

2. Intellectual Property

The contents of the Company’s website are protected by copyright, trademarks, database rights and all relevant intellectual property rights.  You may retrieve and display the contents of the Company’s website on a computer screen, store such contents in electronic form on disk or print one copy of such contents for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise copy, modify, distribute, transmit, publish, reproduce, repost, create derivative works or in any way use for commercial purposes any of the materials or contents on the Company’s website without its written permission.

3. Product Information

3.1 All material and information relating to products presented by WHAT HE WANTS on the Sites is intended to be used for personal educational or informational purposes only. The statements made about the products have not been evaluated by the Health Sciences Authority of Singapore or any other regulator, and the results reported, if any, may not necessarily have the same results on all individuals.

3.2 If any minor uses any products or goods purchased through the Site, it should be only after the parent or legal guardian has discussed the product with the minor.

3.3 The product statements are not intended to diagnose, treat, cure or prevent any condition or disease. References to any products, services, processes or other information by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by WHAT HE WANTS. Product claims or descriptions on the Sites have been provided to us by relevant brand owners or pursuant to customers review and WHAT HE WANTS has not independently verified such claims or descriptions.

3.4 All products should be used strictly in accordance with their instructions, precautions and guidelines. You should always check the ingredients for products to avoid potential allergic reactions.

3.5 Use of our Sites is not meant to serve as a substitute for professional medical advice; these Sites are solely online stores for specialty grooming products. Please consult with your own physician or health care practitioner regarding the use of any goods, products or information received from the Sites before using or relying on them. Your physician or health care practitioner should address any and all medical questions, concerns and decisions regarding the possible treatment of any medical condition. WHAT HE WANTS does not give or intend to give any answers to medical related questions and these Sites do not replace any medical professional or medical resource. WHAT HE WANTS does not represent itself as a physician nor is this implied. No prescription medications or medical treatments are intentionally provided on the Sites. If you are in need of medical attention, call emergency services or your physician immediately.

3.6 While WHAT HE WANTS has tried to accurately display the colours of products, the actual colours you see will depend on your display monitor or screen and may not be accurately rendered.

3.7 While we try to provide an accurate description of the products, we do not warrant that the descriptions, colours, information, pricing, promotions or other content available on the Sites is accurate, current or free from error. WHAT HE WANTS may correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Sites is inaccurate at any time without prior notice, including after you have submitted your order.

3.8 In the event that the product you receive is defective or incorrect, Clause 5 (Returns, Exchanges and Refunds) of the WHAT HE WANTS Terms shall apply.

4. Delivery Terms

4.1. Free delivery for local and *overseas shipping with purchases of RM299 or more. Free delivery is only applicable for local and worldwide orders up to a maximum load of 3kg per order. For wholesale and bulk purchase orders, please contact sales@whathewants.com.my

*Only for specific Zone Areas, please contact us for more details. For international customers whose zone areas do not qualify for free shipping, delivery charge will be advised after confirmation of order.

4.2. All local orders in Malaysia are managed from our JB or Singapore warehouse depending on the availability of stocks . Our courier partners include Gdex/DHL/Aramex/Airpak. Once we have received your order, your item(s) will be dispatched within 1-2 working days (excluding Saturdays, Sundays and Public Holidays). Please make allowance for slower turnaround times during festive and sale periods

4.3. For delivery to a specific area in Malaysia (including East Malaysia), there will be a flat rate of RM9.90 for an order below RM299. Delivery is free for purchase above RM299.

For delivery to all countries outside Malaysia, there will be a flat rate of RM59.90 for an order below RM299. Delivery is also free for overseas orders with purchase above RM299.

5. Exchange and Returns

5.1 For incorrect or defective items shipped, we have a 10 day return policy upon receipt of order by the customer, subject to the following terms and conditions:

Item must be in their original purchase condition. All packaging must be unopened, unused, unmarked and not defaced in any manner.

Items purchased as part of a set or multi-item pack have to be returned as a whole set.

If you have suffered from an allergic reaction medical evidence must be provided such as a doctor’s certificate.

We do not issue returns for poor choice

6. Payment Terms

You shall make full payment for the goods upon placement of your order on WHAT HE WANTS unless stated otherwise.  Delivery of your order will only be made once full payment for the goods has been received by the Company, unless stated otherwise.

We accept Visa, MasterCard, American Express, Delta, and Maestro credit and debit cards. Payment is only debited from your card at time of dispatch. We also accept Paypal.

WHAT HE WANTS is registered with Cybertrust as an authentic site. This ensures that your information is kept private while in transit between your web browser and our web server.

7. Pricing and Product Information

7.1. Prices quoted for all goods and services are in Ringgit (RM). The Company reserves the right to vary the prices of its goods and services without notice to you. All prices provided on WHAT HE WANTS are in Ringgit (“RM”). All prices provided on the site shall be borne by you. You shall pay for the products and/or services at the time an order is made. Payment shall be made by way of debit/credit card.

7.2. The Company shall make every effort to ensure that the prices, details and sizes of products are correct. Not all product sizes will correspond exactly to the description offered. Actual weight may vary up to +10% to the nearest size and price.

7.3. The Company reserves the right to vary the prices of its goods and services without prior notice to you.

8. Promotion Code

8.1. Valid for products at original price only, unless otherwise stated.

8.2. Not exchangeable for cash.

8.3. Strictly valid on the stated date only. No extension of the promotion date will be entertained.

8.4. No combination of other promo codes, discounts, vouchers or promotions is allowed.

8.5. Only can use on WHAT HE WANTS before you check out.

8.6. The management reserves the right to amend terms & conditions without prior notice. In the event of any dispute, the management’s decision is final.

9. Availability of Goods

All orders placed on the WHAT HE WANTS are subject to the Company’s acceptance of the order and availability of the goods at the time of order.  In the event that the goods ordered are not available, the Company shall contact you through the means you have provided it at registration to inform you of alternative options.

In the event you choose not to accept our suggested alternatives or change your original order, we will ship out the available products less the unavailable products and refund the amount to you as applicable.

10. Cancellation

Customer would not be able to change or cancel the order any time after payment has been made. We seek your understanding that the delivery slots are allocated systematically and food products are temperature controlled products hence if an order is cancelled, or if no one is at the delivery location to receive the order, WHAT HE WANTS reserves the right to deny any refunds for the products purchased.

11. Ownership

All Goods shall remain the property of the Company until payment and delivery is done. Placing an order on WHAT HE WANTS does not constitute a contract.  A contract is made only when the Company accepts your payment/order and processed your order.  The Company reserves the right to decline acceptance of your order.

12. Insurance and Liability

The Company shall be responsible for insuring the Goods until the customer’s delivery and/or instructions for receipt have been completed.  Risk of loss of or damage to the Goods passes to you at the time of delivery.

The Company shall not be liable for any fault or deterioration in the Goods it sells to you after its delivery to you as a result of fair wear and tear, wilful damage, accident, negligence by you or any third party, or from your inappropriate handling or storage.

13. Additional Terms and Conditions

From time to time, the Company may offer other services, special offers, discounts, or promotions not specifically referred to in the terms and conditions provided herein.   By accepting the services, special offers, discounts, or promotions, you agree to be bound by additional terms and conditions.

Any special offer is offered on a first come first served basis and are non-returnable/refundable/exchangeable. Products bought from a sale will not be eligible for any further case discount other than the initial saving shown.

14. Provisions are Severable

Each provision of this Agreement is severable; if any one or more provisions contained in this Agreement shall be deemed invalid, unlawful or unenforceable in any respect under any applicable law, the validity, legality and enforceability of the remaining provisions contained herein shall not in any way be affected or impaired.

15. Indemnification

You agree to defend, indemnify and hold the Company harmless from and against any and all claims, damages, costs and expenses, including legal fees arising from or related to your use of this website, or your breach of any representation, warranty, or other provisions of this agreement.

16. Force Majeure

Neither party shall be liable to each other for failure in the performance of any of the obligations imposed by the terms and conditions on this website arising from an act of God, war, sabotage, rebellion, riots, hostile activities, interruptions of transportation or inability to obtain necessary labour, materials of facilities, default of any supplier, acts of governmental or quasi-governmental authorities, regulations or restrictions imposed by law, regulations or by court action, fires, explosion, floods, storms or other catastrophes, (whether or not the kind described herein) over which the affected party has no reasonable control and which is of such nature as to make timely compliance impracticable.

17. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of Singapore. By accessing this WHAT HE WANTS, you irrevocably submit to the non-exclusive jurisdiction of the Singapore courts.

18. Data Policy

The personal data we collect from you or via third parties may be used by us, or shared with or transferred to third parties (including related companies, third party service providers and their service providers and related companies, companies located both inside and outside your home country, third party sellers and other users), for certain purposes, which include but are not limited to the following:

18.1. To facilitate your use of the Services or access to the Platform;

18.2. To respond to your queries, feedback, claims or disputes, whether directly or through our outsourced customer service agents;

18.3. To process orders, you submit through the Platform (Payments that you make through the Platform for products, whether sold by us or a third-party seller, will be processed by our agent);

18.4. To deliver the products you have purchased through the Platform, whether sold by us or a third-party seller. We may pass your personal information on to a third party in order to make delivery of the product to you (for example to our courier or supplier), whether the product is sold through the Platform by us or a third-party seller;

18.5. To update you on the delivery of the products, whether sold through the Platform by us or a third-party seller, and for customer support purposes;

18.6. To compare information, and verify with third parties in order to ensure that the information is accurate;

18.7. To ascertain your identity for fraud detection purposes;

18.8. To facilitate the takedown of prohibited and controlled products from our Platform;

18.9. To administer your account (if any) with us;

18.10. To verify and carry out financial transactions in relation to payments you make online;

18.11. To audit the downloading of data from the Platform;

18.12. To improve the layout or content of the pages of the Platform and customise them for users;

18.13. To identify visitors on the Platform;

18.14. To carry out research on our users’ demographics and behaviour;

18.15. To provide you with information we think you may find useful or which you have requested from us, including information about our or third-party sellers’ products and services, provided you have indicated that you have not objected to being contacted for these purposes;-

To display your name, username or profile on the Platform;

To allow other users to identify you (via the “Find my friends” or any other similar function) as a user of the Service, to allow you to find other users and to connect with them on the Platform, and to support the socialising function of the Services;

To promote the Services and use information that you give to us, such as user-generated content (including video content) that you can choose to upload or broadcast on our Platform and will be accessible on the internet and may be shared by the public (the latter of which is not within our control), as part of our advertising and marketing campaigns to promote the Platform;

To process any complaints, feedback, enforcement action and take-down requests in relation to any content you have uploaded to the Platform;

To display on scoreboards on the Platform in relation to campaigns, mobile games or any other activity;

To derive further attributes relating to you based on personal data provided by you (whether to us or third parties), in order to provide you with more targeted and/or relevant information;

To send you marketing or promotional materials about our or third-party sellers’ products and services from time to time (unless you choose to opt-out from receiving these materials); and

We may also conduct automated decision-making processes in accordance with any of these purposes.

19. Controlling your personal information

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so. If you have previously agreed to us using your personal information for direct marketing purposes, you may change your mind at any time by writing to or emailing us at sales@whathewants.com.my. If you believe that any information we are holding on you is incorrect or incomplete, please write to or email us as soon as possible, at the above address. We will promptly correct any information found to be incorrect.

20. Website Security

The Company makes all reasonable endeavours to ensure the integrity and security of the server. The Company does not guarantee that the server will be free from unauthorised use or hacking. WooCommerce website, App and Service may be subjected to limitations, delays and other problems inherently and in any such event, WHAT HE WANTS shall not be liable for any loss, liability or damage, which may be incurred as a result.
